1. Who we are

ARBS Academy is an online education and exam-preparation service operated by Aether Brains in Bangladesh (collectively, “ARBS Academy”, “we”, “us” or “our”). These Terms apply to our website, applications, content, features and related services (the “Service”).

2. Acceptance and eligibility

By creating an account, buying Premium, or otherwise using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

You must be legally capable of entering into this agreement. ARBS Academy is for people preparing for jobs and is meant for adults aged 18 and over. If you are under 18, you may use it only with the consent of a parent or guardian, who must review and agree to these Terms for you. You may not use the Service if applicable law prohibits it.

3. Accounts and security

• Provide accurate information and keep it current.
• Keep your password and access to your email or Google account secure. You are responsible for activity performed through your account unless you promptly tell us of unauthorised access.
• Use only one personal account unless we approve otherwise. Accounts and Premium access may not be sold, transferred or shared.
• We may require email verification, security checks or additional information to protect the Service and its users.

Tell us promptly through the contact form if you believe your account has been compromised.

4. The Service and educational disclaimer

ARBS Academy provides practice questions, explanations, lessons, mock and live exams, study tracking, job circular links, discussions and related tools. We may add, change or discontinue features as the Service develops.

The Service is an independent preparation platform. It is not affiliated with, endorsed by, or an official source for the Government of Bangladesh, Bangladesh Public Service Commission, Bangladesh Bank, any recruiting body, educational institution or employer unless we expressly state otherwise. Content is for study and general information only. We do not guarantee that content is complete or error-free, that a particular question will appear in an examination, or that use of the Service will result in employment, admission, a score or any other outcome. Always verify deadlines, eligibility rules and circular details with the issuing authority.

5. Free access, Premium and trials

Some features are free and others require Premium. Current features, prices, access periods and limits shown at pricing or checkout form part of these Terms. A purchase grants a personal, limited, non-transferable right to use the applicable Premium features for the stated period; it does not transfer ownership of any content.

Any trial is available only as displayed at sign-up or checkout, may be limited to one per person, and may be withdrawn or changed for future users. Premium does not automatically renew unless checkout expressly says recurring billing applies and you separately authorise it.

6. Payments, activation and refunds

Prices are displayed in Bangladeshi Taka (BDT). Payments are processed by the provider identified at checkout. You authorise us and that provider to process the transaction and customer details needed to complete it. Premium is activated only after we receive and verify a successful payment confirmation.

All payments are non-refundable. Premium is digital access that starts as soon as a payment is confirmed, so a completed purchase is final and is not refunded, in whole or in part, including when Premium is not used or is ended early. Please use the free trial to decide before you buy. If a payment was taken but Premium was not activated, or you were charged twice or the wrong amount, contact us with the receipt or transaction reference and we will correct the access or the charge. A failed, cancelled or pending payment does not create Premium entitlement.

7. Acceptable use

You must not:

• break any law, infringe another person’s rights, impersonate someone, harass others, or post unlawful, deceptive, abusive or harmful material;
• share live-exam questions before an exam ends, cheat, manipulate scores, votes, referrals, rewards or leaderboards, or use multiple accounts to obtain benefits;
• copy, scrape, crawl, download in bulk, republish, sell or commercially exploit the Service or its content without written permission;
• reverse engineer, bypass access controls or usage limits, probe for vulnerabilities, introduce malware, disrupt the Service, or automate access except through an interface we expressly provide; or
• collect another user’s personal information or access another account without permission.

8. User content and community features

You retain ownership of content you submit, such as posts, comments, feedback and suggestions (“User Content”). You give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, display and distribute User Content only as reasonably needed to operate, secure, moderate and improve the Service and make public posts available. This licence ends when content is deleted from active systems, except for lawful retention, backups and content already shared by others.

You represent that you have the rights needed to submit User Content. We may remove, restrict or preserve content where it violates these Terms, risks harm, or must be handled to comply with law. Feedback and product suggestions may be used without restriction or compensation, but we will not publicly identify you as their author without permission.

9. Our content and intellectual property

The Service, software, design, branding, original explanations, lessons, question organisation and other materials we create are owned by or licensed to Aether Brains and protected by applicable intellectual-property laws. We grant you a revocable, non-exclusive, non-transferable licence to access them for personal, non-commercial study while these Terms remain in effect.

Past public recruitment questions may originate from the relevant examining bodies. Their inclusion does not imply sponsorship or ownership by ARBS Academy. Third-party names, marks, circulars and linked materials remain the property of their respective owners.

10. Rewards, referrals and leaderboards

Points, badges, streaks, rankings and similar in-service rewards have no cash value, are not property, and cannot be transferred or redeemed except under an offer we expressly publish. We may correct errors, reverse fraudulently obtained rewards, set caps and eligibility rules, or change and discontinue programmes. Referral rewards may be withheld or reversed for self-referrals, duplicate or fraudulent accounts, automated activity or other abuse.

Leaderboard participation is optional and subject to the visibility controls shown in the Service. Public profile or leaderboard information may include your chosen username, avatar and study performance.

11. Third-party services and links

The Service may use or link to third-party services, including Google sign-in, payment processing and official job-circular websites. Third parties operate under their own terms and privacy policies. We are not responsible for third-party content, availability or acts, and a link is not an endorsement. Review the destination and its terms before relying on it or providing information.

12. Suspension and termination

You may stop using the Service at any time and may request account deletion through the contact details below. We may restrict, suspend or terminate access where we reasonably believe you breached these Terms, created risk or legal exposure, used the Service fraudulently, or where required by law. Where appropriate, we will give notice and a reasonable opportunity to appeal. Serious security, fraud or legal concerns may require immediate action.

Termination ends your licence to use the Service. Provisions that by nature should continue—including ownership, payment obligations, disclaimers, liability limits and dispute terms—survive termination.

13. Availability, disclaimers and liability

We work to keep the Service useful, accurate and secure, but it is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we do not make implied warranties of uninterrupted availability, fitness for a particular purpose, non-infringement or error-free content. Nothing in these Terms excludes a warranty, remedy or liability that cannot legally be excluded.

To the maximum extent permitted by law, Aether Brains and its team will not be liable for indirect, incidental, special or consequential loss, lost opportunity, lost profits or lost data arising from use of the Service. Our total liability arising from Premium will not exceed the amount you paid us for Premium during the 12 months before the event giving rise to the claim. This limit does not apply to fraud, wilful misconduct, gross negligence, or liability that applicable law does not permit us to limit.

14. Changes to the Service or these Terms

We may update these Terms to reflect legal, security, operational or product changes. We will post the revised version and update the date above. If a change materially affects your rights, we will provide reasonable advance notice through the Service or by email where practicable. Changes apply prospectively from their stated effective date. If you do not agree, you must stop using the Service; continued use after the effective date constitutes acceptance where permitted by law.

15. Governing law and disputes

These Terms are governed by the laws of Bangladesh, including applicable principles of the Contract Act, 1872 and consumer-protection law. Please contact us first so we can try to resolve a concern informally. Subject to any mandatory consumer forum or other jurisdiction provided by law, the courts of Dhaka, Bangladesh will have exclusive jurisdiction over disputes arising from these Terms or the Service.

16. General terms

If a provision is unlawful or unenforceable, it will be limited or removed only to the extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign this agreement without our written consent; we may assign it as part of a reorganisation, financing, merger or transfer of the Service, subject to applicable law. These Terms, the Privacy Policy and any checkout terms are the entire agreement about the Service and replace earlier discussions on the same subject.
